Sheriff's Office investigates Mulino shooting incident, arrest man for attempted murder of brother

On Tuesday, Aug. 17, 2010 at 12:36 p.m., one brother allegedly discharged a semi-automatic handgun multiple times at his estranged brother, who was standing outside a residence under construction in Mulino.

No injuries were reported -- and the armed suspect was soon apprehended without incident by Clackamas County Sheriff's Office deputies a short distance from the scene.

Deputies investigating the incident report that victim Timothy Bilyeu had placed some personal effects belonging to his brother -- suspect John Bilyeu -- at the end of a residential driveway located at 25481 S. Newkirchner Rd. in Mulino.

John Bilyeu reportedly arrived at this residence to collect his property while driving a gray-colored 1994 Ford F-250 pickup.

Upon arrival, the personal items situated at the end of the driveway were collected, and John Bilyeu reportedly approached the residence along the driveway of this property, which is under construction.

As John Bilyeu approached the residence, he was greeted by his brother Timothy Bilyeu in the driveway.

Investigators report that a verbal exchange between the two brothers erupted over the topic of money. It is believed that John Bilyeu then allegedly presented a handgun -- discharing multiple rounds in an effort to hit the intended target, Tim Bilyeu.

Miraculously, Tim Bilyeu escaped injury -- moving quickly and taking cover behind a large backhoe on the property. Tim Bilyeu described "dancing around" this piece of machinery while attempting to avoid being struck by the rounds allegedly being discharged by his brother.

John Bilyeu -- having missed his intended target -- jumped into his pick-up truck, intending to flee the area. Responding deputies came upon the suspect and his pick-up truck on South Buckner Creek Road, an estimated quarter-mile from the victim's residence -- apparently moments after John Bilyeu became stuck just off the narrow roadway while attempting to turn the truck around.

This suspect was arrested at gunpoint, without incident, by deputies. A handgun was later recovered by deputies from John Bilyeu's vehicle and retained as evidence.

Victim Timothy Lee Bilyeu, age 43, lives at the rural residential address (25481 S Newkirchner Rd., Mulino) with his fiancé and her three minor children, who were also on the property at the time of the incident, but were also not injured. The couple is expected to be wed this coming Saturday (Aug. 21).

John Eric Bilyeu, age 44, of southeast Portland, was arrested and lodged in Clackamas County Jail on a charge of Attempted Murder.

Arraignment on this matter is scheduled for Wednesday, Aug. 18, 2010, at 3 p.m. in Clackamas County Circuit Court in Oregon City.
